(Swainsboro, GA) – The streets of Swainsboro, Georgia were quiet early this Saturday morning near the year’s end – until a wild car chase broke out between the Georgia State Patrol – and three fleeing suspects – that ended with a rollover and one suspect seriously injured.

2018 will be a year of recovery for one suspect who was seriously injured and trapped in the rollover.

The suspect vehicle crashed near the intersection of Old Nunez Road/Dawson Street and Sycamore Street in residential Swainsboro – a check of a map shows Old Nunez Rd. actual changed names near the crash to Dawson St.

The suspects were in a chase “with GSP – it’s gonna be a rollover,” said one of the first officers on the scene. The Georgia State Patrol trooper was not injured.

The chase began early today around 12:30 a.m. ET this morning, Sat., Dec. 30, 2017.

Medivac helicopter crew 911 was launched and landed at the local airport.

“Medivac 91 is going to be on standby” said the dispatcher updating police on the scene.

“Go ahead and tell them to lift off,” said a supervising officer on the scene.

“We have two in handcuffs,” one officer said adding they were being checked by paramedics and first responders. “We still got one in the vehicle partially trapped”

Two suspects – who freed themselves from the car – were immediately put in handcuffs. The pair was checked over by paramedics, however their friend is not so lucky.

A 32-year-old African American male was medivac’d to a shock trauma hospital – likely Georgia Regents University Hospital in Augusta. The man had been trapped in the demolished car for almost an hour. He was seriously injured.

The entire neighborhood was closed down by police.

“Come down Harrington Street so they can get to the vehicle,” one of said to another. “Right here by the water tower.”

Just what started the chase with GSP isn’t clear or if officer’s found any evidence in the vehicle.

(St .Mary’s, Georgia) – First arrest after DEA “conspiracy” raid on an alleged fake pain and rehab clinic in Camden County, Georgia allegedly involved in the distribution of opioids charged up to $300 per prescription – and sent drugs seekers to a pharmacy controlled by co-conspirators, the feds say.

Numerous arrests are expected – however the first person charged is 46-year-old Silverly Ann May who has several Florida addresses. The clinic is near the state line.
May faces up to five years in federal prison if convicted of felony “conspiracy.”

Pain clinic graphic 2
The clinic was raid in June 2017 and the first charges were filed on Thurs., Dec. 21, 2017
In fact, the alleged conspiracy deposited over $1.2 million dollars in a bank account.
The feds allege the pain clinic trafficked illegally in opioids such as oxycodone, hydromorphone, hydrocodone, and alprazolam.

The investigation involves the “Coastline Physical Medicine and Rehabilitation, a nominal pain care clinic” at 40l1 Georgia Highway 40 East in St. Mary’s, Georgia.
The alleged conspiracy began on Oct. 9, 2014 and ended on June 13, 2017 – when federal agents moved in.

The co-conspirators allegedly plan involved to “knowingly and intentionally distribute and dispense, and cause to be distributed and dispensed, quantities of controlled substances, including oxycodone, hydromorphone, and hydrocodone, Schedule II controlled substances, and alprazolam, a Schedule IV controlled substance, not for a legitimate medical purpose and not in the usual course of professional practice,” the felony federal information, a charging tool used in addition to indictments.

“Members of the conspiracy” hired and trained employees and employed one doctor (unnamed in the criminal information) in an alleged effort to look legitimate.

“Drug seeking customers typically paid between $200 and $300” to the alleged bogus clinic “in exchange for prescriptions for controlled substance.” The drug seekers then “filed at one of more pharmacies , controlled by conspirators outside the usual course of professional practice and without legitimate medial purpose,: the criminal information charges

The conspirators opened and made use of Ameris Bank” by opening an account “to promote and facilitate the criminal activity” that allegedly include numerous types of opioids.

The deposits total over $1.2 million dollars – $1,271, 940.11.
Some of money was used to pay employees and operate the alleged fake pain clinic.
The co-conspirators plan was allegedly “to conceal or disguise the nature, the location, the sources, the ownership, or control of the proceeds of specified unlawful activity,” federal prosecutors charge.

The Southern District of Georgia federal prosecutors who closed down the clinic and are expected to file more charges as part of the conspiracy:
U.S. Attorney for the Southern District of Georgia Bobby L. Christine
Assistant U.S. Attorney Brian T. Rafferty, criminal division chief
Assistant U.S. Attorney Karl I. Knoche

Plea agreement for Fort Gordon Soldier Jerel Sampay (who was employed at the Youth Challenge Academy):
Victim in case is Jaquan Tovarez Moore

United States District Court Southern District of Georgia Augusta Division United States of America
Plea Agreement Defendant Jerel Sampay, represented by his counsel Joseph T. Rhodes, and the United States of America, represented by Special Assistant United States Attorney Candace R. Cunningham, have reached a plea agreement in this case. The terms and conditions of that agreement are as follows. L Guilty Plea Defendant agrees to enter a plea of guilty to Count One:
The elements necessary to prove the offense charged in Count One are (1) that the defendant assaulted Jaquan Tovarez Moore by striking him; and (2) the assault took place within the special maritime and territorial jurisdiction of the United States. Defendant agrees that he is, in fact, guilty of this offense.
He agrees to the accuracy of the following facts, which satisfy each of the offense’s required elements:
On 29 January 2017, Mr. Sampay was employed by the Youth Challenge Academy, located on Fort Gordon. The defendant entered the Youth Challenge Academy bay door and proceeded to shove the victim with his right arm, which knocked the victim onto a bunk. The victim got up and said something to the defendant, in response to which the defendant got into the victims face and shoved him.
The victim shoved the defendant back and the defendant shoved the victim in the face twice, which knocked the victim back onto a bunk. The defendant then struck the victim about the head with his right fist. The defendant and the victim continued to scuffle while others attempted to intervene. Soon after, cadre and other cadets were able to break up the fight.
3. Possible Sentence Defendant’s guilty plea will subject him to the following maximum possible sentence: Count One: Not more than 6 months imprisonment; a fi ne of not more than $5,000.00; and a $10 special assessment. 4. No Promised Sentence No one has promised the defendant that the Court will impose any particular sentence or a sentence within any particular range. The Court is not bound by any estimate of sentence given or recommendations made by the defendant’s counsel, the government, the U.S. Probation Office, or anyone else. The Court may impose a sentence up to the statutory maximum. The defendant will not be allowed to withdraw his plea of guilty if he receives a more severe sentence than he expects.
4. 5. Recommended Sentence The Government agrees to recommend a sentence consisting of a $1,000 fine, 100 hours community service, 6 months’ probation, and $10 special assessment.
5. 6. Court’s Use of Sentencing Guidelines The Court is obligated to use the United States Sentencing Guidelines to calculate the applicable guideline range for Defendant’s offense. The Sentencing Guidelines are advisory; the Court is not required to impose a sentence within the range those Guidelines suggest. The Court will consider that range, possible departures under the Sentencing Guidelines, and other sentencing factors under 18 U.S.C. § 3553(a), in determining the Defendant’s sentence. The Sentencing Guidelines are based on Defendant’s relevant conduct, pursuant to U.S.S.G. § IB 1.3, not just the conduct underlying the particular Count or Counts to which Defendant is pleading guilty.
6. 7. Agreements Regarding Sentencing Guidelines a. Use of Information Nothing in this agreement precludes the government fr om providing full and accurate information to the Court and U.S. Probation Office for use in calculating the applicable Sentencing Guidelines range. Any incriminating information provided by the defendant during his cooperation will not be used in determining the applicable Guidelines range, pursuant to Section 1B1.8 of the Sentencing Guidelines. b. Acceptance of Responsibility The government will not object to a recommendation by the U.S. Probation Office that Defendant receive a two-level reduction in offense level for acceptance of responsibility pursuant to Section 3El.l(a) of the Sentencing Guidelines. If the U.S. Probation Office makes that recommendation, and Defendant’s offense level is 16 or Case 1:17-po-00030-BKE Document 26 Filed 12/07/17 Page 3 of 11

Plea agreement:
Wendy Shumans “swerved off the road and struck a sign, moved back onto the road, and struck another vehicle. “
Investigator Stephen Lugo responded to the resulting call for service, and, upon arrival, saw the Defendant’s vehicle and the other vehicle that was involved in the accident.
Wendy Shumans “was discovered unconscious behind the wheel and did not respond after Investigator Lugo attempted to wake her up several times. Eventually the Defendant awoke long enough to initiate a Standardized Field Sobriety test but Law Enforcement personnel were unable to complete it due to the Defendant’s intoxicated state.”
Shumans “was transported to the hospital by EMS and a blood sample was taken. The Defendant was advised of GA implied consent and agreed to the blood draw. The medical facility kept the Shumans “overnight, and during the next day Investigator Lugo read the Defendant her rights and the Defendant agreed to answer questions.”
Shumans stated that she did not recall striking a sign, hitting another vehicle, or even that an accident had occurred.”
Shumans “did say that she had consumed three bottles of wine the morning of the incident. The toxicology report showed a BAG of 0.337%.”

Inmate Death Under Investigation

October 31, 2017

FORSYTH, Ga. – The Georgia Department of Corrections (GDC) is investigating the death of an inmate at Hancock State Prison.

A Correctional Officer found inmate Roy Bradshaw (GDC#141503) unresponsive in his cell at 7:44 a.m. on October 31.  Prison medical staff provided life saving measures to revive him. At 8:30 a.m., Emergency Medical Services arrived on scene and the inmate was pronounced deceased at 8:34 a.m. by the EMT. GDC is conducting an investigation into the death, as standard procedure.

Bradshaw was sentenced with Life Without Parole in 2009, in Putnam County, for Murder, Aggravated Assault and Robbery. Further information and photographs can be found on the GDC website at http://www.gdc.ga.gov.

BRADSHAW v. THE STATE.

S16A1070

    Decided: October 31, 2016

Appellant Roy Lee Bradshaw was tried and convicted of malice murder and related offenses in connection with the March 2008 beating death of Earl Gill. Bradshaw appeals,1 alleging he received ineffective assistance of counsel and arguing that the trial court erred in admitting his custodial statements at trial. Finding no error, we affirm.

Viewed in the light most favorable to the jury’s verdict, the evidence adduced at trial establishes as follows. Earl Gill befriended Bradshaw, his wife Teresa, and the Morrises, Bradshaw’s co-defendants, while staying at an Econolodge in Milledgeville, Georgia. On March 15, 2008, Gill called his drug dealer, Michael Robbins, to arrange a drug buy for himself, Bradshaw, and the Morrises, funded by the group. Later that day, Gill drove with Robbins to a nearby Wal-Mart to complete the drug transaction. Upon their arrival at the store, Gill gave Robbins the group’s money. Robbins then entered the store under the pretense of completing the drug deal, but he never returned. After a fruitless search for Robbins, Gill walked back to the Econolodge and informed Bradshaw and the Morrises that Robbins had taken their money.

Believing that Gill was in on the theft, Bradshaw and the Morrises forced Gill into the back of Bradshaw’s van and, with Teresa in the driver’s seat,2 the group proceeded to ride around town in search of the stolen money. During the search, the men periodically struck Gill and, with each unsuccessful stop, they grew angrier and more convinced that Gill had stolen their money.

Eventually, Bradshaw had Teresa pull to the side of the road after which he and the Morrises dragged Gill from the vehicle and beat him for an extended period of time, finally leaving the victim for dead. Somehow, Gill managed to regain consciousness and stumble to a nearby home. When the owners saw Gill’s extensive injuries, they took him to the hospital where he died 9 days later from severe blunt force injuries to his head.

At trial, the jury heard many witnesses testify as to the numerous post-incident inculpatory statements made by Bradshaw, his wife, and the Morrises concerning their participation in Gill’s murder. Bradshaw also confessed to law enforcement that he and the Morrises beat the victim in the van and on the side of the road. Gill’s blood was found inside Bradshaw’s van, along with a bloody baseball bat and medium force velocity blood spatter, consistent with Gill being struck with a fist or bat.
